### sec.318P When decision takes effect
If the proposed action decision is to cancel or suspend the registration, the decision takes effect on the later of the following—
the day the information notice is given to the operator under section 318O (1) (a) ;
a later day of effect stated in the notice.
However, if the decision was to cancel or suspend the registration because of the conviction of the operator for an offence, the cancellation or suspension—
does not take effect until—
the period to appeal against the conviction ends; and
if the appeal is made against the conviction—the appeal is finally decided or is otherwise ended; and
has no effect if the conviction is quashed on appeal.

(sec.318P-ssec.2) However, if the decision was to cancel or suspend the registration because of the conviction of the operator for an offence, the cancellation or suspension— does not take effect until— the period to appeal against the conviction ends; and if the appeal is made against the conviction—the appeal is finally decided or is otherwise ended; and has no effect if the conviction is quashed on appeal.
- (a) the day the information notice is given to the operator under section 318O (1) (a) ;
- (b) a later day of effect stated in the notice.
- (a) does not take effect until— (i) the period to appeal against the conviction ends; and (ii) if the appeal is made against the conviction—the appeal is finally decided or is otherwise ended; and
- (i) the period to appeal against the conviction ends; and
- (ii) if the appeal is made against the conviction—the appeal is finally decided or is otherwise ended; and
- (b) has no effect if the conviction is quashed on appeal.
