### sec.316C Application of division This division applies if the administering authority, or the State, incurs, or might reasonably incur, costs and expenses in taking action to— prevent or minimise environmental harm, or rehabilitate or restore the environment, in relation to the carrying out of an activity for which an EPA assurance or scheme assurance has been given; or secure compliance with an environmental authority or prescribed condition for a small scale mining activity for which an EPA assurance or scheme assurance has been given. If the State incurs, or might reasonably incur, the costs and expenses, the administering authority may act under this division on behalf of the State. s 316C ins 2018 No. 30 s 173 amd 2023 No. 6 s 52 (sec.316C-ssec.1) This division applies if the administering authority, or the State, incurs, or might reasonably incur, costs and expenses in taking action to— prevent or minimise environmental harm, or rehabilitate or restore the environment, in relation to the carrying out of an activity for which an EPA assurance or scheme assurance has been given; or secure compliance with an environmental authority or prescribed condition for a small scale mining activity for which an EPA assurance or scheme assurance has been given.
