### sec.254 Protection from liability
In this section—
civil liability includes liability for the payment of costs ordered to be paid in a proceeding for an offence against this Act.
official means—
the Minister; and
the regulator; and
officers of the department assisting the regulator to perform functions under section 63 ; and
an operator under section 131 and employees of an operator; and
inspection officers; and
members of advisory committees appointed by the Minister or under a regulation; and
members of any board established under this Act.
An official or QCA does not incur civil liability for an act done, or an omission made, honestly and without negligence under this Act.
If subsection (2) prevents a civil liability attaching to an official or QCA, the liability attaches instead to the State.
