### sec.420 What is a matrimonial instrument
An instrument mentioned in subsection (2) that provides for the transfer of matrimonial property from 1 party to a marriage to only the other party to the marriage is a matrimonial instrument on the dissolution or annulment of the marriage.
For subsection (1) , the instruments are the following—
an agreement registered or approved under the Family Law Act 1975 (Cwlth) ;
an order of a court under the Family Law Act 1975 (Cwlth) ;
an instrument made under an instrument mentioned in paragraph (a) or (b) ;
an instrument made after the start of a proceeding for the dissolution or annulment of the marriage.
(sec.420-ssec.1) An instrument mentioned in subsection (2) that provides for the transfer of matrimonial property from 1 party to a marriage to only the other party to the marriage is a matrimonial instrument on the dissolution or annulment of the marriage.
(sec.420-ssec.2) For subsection (1) , the instruments are the following— an agreement registered or approved under the Family Law Act 1975 (Cwlth) ; an order of a court under the Family Law Act 1975 (Cwlth) ; an instrument made under an instrument mentioned in paragraph (a) or (b) ; an instrument made after the start of a proceeding for the dissolution or annulment of the marriage.
- (a) an agreement registered or approved under the Family Law Act 1975 (Cwlth) ;
- (b) an order of a court under the Family Law Act 1975 (Cwlth) ;
- (c) an instrument made under an instrument mentioned in paragraph (a) or (b) ;
- (d) an instrument made after the start of a proceeding for the dissolution or annulment of the marriage.
