### sec.40 When a clerk of the court is registrar, the clerk’s successor or deputy shall be registrar
When a clerk of the court is appointed registrar of the District Court held at the place where the person is clerk, the successor in office of the clerk, or a deputy, or a person performing the duties for the time being, shall exercise, and have the rights and powers, and shall perform the duties of a registrar of the District Court while the person is performing the duties of such clerk.
However, subsection (1) does not limit the chief executive’s power under section 36 (2) .
In this section—
clerk of the court has the meaning assigned to that expression by the Justices Act 1886 .
