### sec.43AH Maximum penalty for indictable offences dealt with summarily
The maximum penalty that may be imposed on a summary conviction of an indictable offence is 3 years imprisonment or the maximum prescribed for the offence, whichever is the lesser.
However, in no case may a person be punished more than if the offence had been dealt with on indictment.

(sec.43AH-ssec.1) The maximum penalty that may be imposed on a summary conviction of an indictable offence is 3 years imprisonment or the maximum prescribed for the offence, whichever is the lesser.
