### sec.159 What is an innocent interest exclusion order An innocent interest exclusion order is an order that— states the nature, extent and, if necessary for the order, the value when the order is made, of the applicant’s interest in the property; and if the application for the forfeiture order has not been decided, excludes the applicant’s property from the operation of any restraining order applying to the property and the application for the forfeiture order; and if the applicant’s property has been forfeited to the State and is still vested in the State, directs the State to transfer the property to the applicant; and if the applicant’s property has been forfeited to the State and is no longer vested in the State, directs the State to pay to the applicant the value of the applicant’s property. s 159 sub 2003 No. 77 s 55 - (a) states the nature, extent and, if necessary for the order, the value when the order is made, of the applicant’s interest in the property; and - (b) if the application for the forfeiture order has not been decided, excludes the applicant’s property from the operation of any restraining order applying to the property and the application for the forfeiture order; and - (c) if the applicant’s property has been forfeited to the State and is still vested in the State, directs the State to transfer the property to the applicant; and - (d) if the applicant’s property has been forfeited to the State and is no longer vested in the State, directs the State to pay to the applicant the value of the applicant’s property.
