60 Samples
(1) This section applies to a sample taken from a relevant person under
this Act in relation to the investigation of a matter by a police officer
if there is sufficient material for an analysis to be carried out by or for
the relevant person and the officer.
(2) A police officer must ensure that reasonable care is taken to ensure
that a part of the material sufficient for analysis to be carried out by
or for the relevant person is protected and preserved until—
(a) if the relevant person makes a request under subsection (3)—the
person receives it; or
(b) in any other case—the material is required to be destroyed under
this Act or by a court order.
(3) The relevant person may request that a part of the material sufficient
for analysis be made available to the relevant person as soon as
practicable.
Note Section 103 provides that the request may be made by the lawyer or
(4) If the relevant person makes a request under subsection (3)—
(a) a police officer must ensure that a part of the material sufficient
for analysis is made available to the relevant person as soon as
practicable; and

that the material is protected and preserved until it is analysed.
