### sec.46 Seizing and otherwise dealing with mail containing information about the commission of an offence
If a search of a prisoner’s mail reveals information about the commission of an offence—
the mail may be seized by—
if it is privileged mail—the chief executive; or
if it is ordinary mail—a corrective services officer; and
the chief executive must give the information revealed in the mail to the relevant law enforcement agency.
Subsection (1) does not apply if the prisoner’s mail is privileged mail and the information is about the commission of the offence for which the prisoner is being detained.
(sec.46-ssec.1) If a search of a prisoner’s mail reveals information about the commission of an offence— the mail may be seized by— if it is privileged mail—the chief executive; or if it is ordinary mail—a corrective services officer; and the chief executive must give the information revealed in the mail to the relevant law enforcement agency.
(sec.46-ssec.2) Subsection (1) does not apply if the prisoner’s mail is privileged mail and the information is about the commission of the offence for which the prisoner is being detained.
- (a) the mail may be seized by— (i) if it is privileged mail—the chief executive; or (ii) if it is ordinary mail—a corrective services officer; and
- (i) if it is privileged mail—the chief executive; or
- (ii) if it is ordinary mail—a corrective services officer; and
- (b) the chief executive must give the information revealed in the mail to the relevant law enforcement agency.
