### sec.431 Suspension of parole order by chief executive
This section applies to a post-prison community based release order (the previous order ) that was suspended by an order of the chief executive under previous section 149 if the suspension was in force immediately before the commencement.
The previous order is taken to have been suspended under section 201(2).
If, because of the suspension, the chief executive issued a warrant under previous section 149(2) and the warrant was in effect and had not been executed before the commencement, it—
continues to have effect according to its terms; and
is taken to be a warrant issued under section 202.
If the chief executive had not issued a warrant under previous section 149(2), the chief executive may issue a warrant under section 202 for the prisoner the subject of the previous order.
(sec.431-ssec.1) This section applies to a post-prison community based release order (the previous order ) that was suspended by an order of the chief executive under previous section 149 if the suspension was in force immediately before the commencement.
(sec.431-ssec.2) The previous order is taken to have been suspended under section 201(2).
(sec.431-ssec.3) If, because of the suspension, the chief executive issued a warrant under previous section 149(2) and the warrant was in effect and had not been executed before the commencement, it— continues to have effect according to its terms; and is taken to be a warrant issued under section 202.
(sec.431-ssec.4) If the chief executive had not issued a warrant under previous section 149(2), the chief executive may issue a warrant under section 202 for the prisoner the subject of the previous order.
- (a) continues to have effect according to its terms; and
- (b) is taken to be a warrant issued under section 202.
