### sec.379 Requirement for test sample before commencement but test sample not given
This section applies if—
a person was required to give a test sample as mentioned in previous section 30; and
the person had not complied with the requirement before the commencement.
The previous requirement is taken to be a requirement under section 41.
(sec.379-ssec.1) This section applies if— a person was required to give a test sample as mentioned in previous section 30; and the person had not complied with the requirement before the commencement.
(sec.379-ssec.2) The previous requirement is taken to be a requirement under section 41.
- (a) a person was required to give a test sample as mentioned in previous section 30; and
- (b) the person had not complied with the requirement before the commencement.
