### sec.324AA Provision of notice or information to eligible person
The chief executive must not give an eligible person a notice or information under this Act unless—
the person has given the chief executive a signed declaration stating that the person will not disclose, for public dissemination, any notice or information about a prisoner given to the person under this Act; and
if a nominee for the eligible person is noted in the eligible persons register—both the nominee and the eligible person have given the chief executive a signed declaration stating that the person will not disclose, for public dissemination, any notice or information about a prisoner given to the nominee under this Act.
The chief executive may refuse to give an eligible person a notice or information under this Act if the chief executive reasonably believes that giving the notice or information to the person may endanger—
the security of a corrective services facility; or
the safe custody or welfare of a prisoner; or
the safety or welfare of someone else.
If there is a nominee of an eligible person on the eligible persons register when the chief executive is required or authorised to give a notice or information to the eligible person, the chief executive—
must endeavour to give the notice or information to the nominee; but
may give the notice or information directly to the eligible person if the chief executive has been unable to give the notice or information to the nominee despite a reasonable attempt to do so.
A requirement to give a notice or information to an eligible person ceases to apply if the chief executive has made a reasonable attempt to give the notice or information to the person but has been unable to do so.
This section does not apply to confidential information disclosed to an eligible person or nominee under section 341 .

(sec.324AA-ssec.1) The chief executive must not give an eligible person a notice or information under this Act unless— the person has given the chief executive a signed declaration stating that the person will not disclose, for public dissemination, any notice or information about a prisoner given to the person under this Act; and if a nominee for the eligible person is noted in the eligible persons register—both the nominee and the eligible person have given the chief executive a signed declaration stating that the person will not disclose, for public dissemination, any notice or information about a prisoner given to the nominee under this Act.
(sec.324AA-ssec.2) The chief executive may refuse to give an eligible person a notice or information under this Act if the chief executive reasonably believes that giving the notice or information to the person may endanger— the security of a corrective services facility; or the safe custody or welfare of a prisoner; or the safety or welfare of someone else.

(sec.324AA-ssec.4) A requirement to give a notice or information to an eligible person ceases to apply if the chief executive has made a reasonable attempt to give the notice or information to the person but has been unable to do so.

- (a) the security of a corrective services facility; or
