30 Detention in police cells
(1) A person lawfully required to be in police custody may, for the
purposes of the custody, be detained at a police cell.
(2) However, a person lawfully required to be in police custody must not
be detained continuously at a police cell for a period longer than the
following period (the allowed period):
(a) for a detainee (other than a young detainee)—36 hours;
(b) for a young detainee—12 hours.
(3) If a person is lawfully required to remain in police custody for a
period longer than the allowed period, the chief police officer may
direct that the person be transferred to the custody of the
director-general for the purposes of the police custody.
(4) The direction by the chief police officer—
(a) authorises the director-general to have custody of the person
under the direction; and
(b) requires the director-general to do the following:
(i) take the person into custody;
(ii) arrange for the person’s admission to a correctional centre;
(iii) keep the person in custody under full-time detention under
the direction;
(iv) provide for police access to the person;
(v) return the person to the custody of the chief police officer
as required by the direction.
(5) To remove any doubt, the person is also taken to remain in police
custody while in custody under subsection (4).
