128 Seizing property—general
(1) The director-general may seize—
(a) anything found at a correctional centre, whether or not in a
person’s custody or possession, that the director-general
suspects, on reasonable grounds, jeopardises or is likely to
jeopardise—
(i) security or good order at a correctional centre; or
(ii) the safety of anyone at a correctional centre; or
(b) anything found at a correctional centre, whether or not in a
person’s possession, that the director-general suspects, on
reasonable grounds, is being used, or is intended, for the
commission of an offence or a disciplinary breach; or
(c) a prohibited thing found on a detainee or in a detainee’s custody
or possession, unless the detainee has the written approval of the
director-general to possess the thing.
(2) To remove any doubt, this section extends to anything found in a
search under part 9.4 (Searches).
(3) The director-general may seize a document only if the
director-general believes, on reasonable grounds, that the document
is not legally privileged.
