### sec.110 Application of subdivision
This subdivision applies if—
a person makes a relevant application; and
the lot to be reconfigured includes land (the prescribed land ) that is—
in a coastal management district; and
in an erosion prone area or within 40m of the foreshore; and
the planning chief executive is—
if the relevant application is a development application—the assessment manager or a referral agency for the application under the Planning Act ; or
if the relevant application is a change application—the responsible entity or a referral agency for the application under the Planning Act .

- (a) a person makes a relevant application; and
- (b) the lot to be reconfigured includes land (the prescribed land ) that is— (i) in a coastal management district; and (ii) in an erosion prone area or within 40m of the foreshore; and
- (i) in a coastal management district; and

- (c) the planning chief executive is— (i) if the relevant application is a development application—the assessment manager or a referral agency for the application under the Planning Act ; or (ii) if the relevant application is a change application—the responsible entity or a referral agency for the application under the Planning Act .
- (i) if the relevant application is a development application—the assessment manager or a referral agency for the application under the Planning Act ; or
- (ii) if the relevant application is a change application—the responsible entity or a referral agency for the application under the Planning Act .
- (i) in a coastal management district; and
- (ii) in an erosion prone area or within 40m of the foreshore; and
