### sec.49J Deciding application
The CEO must decide to give or refuse to give the approval—
within 3 months after the application is made; or
if the CEO and applicant agree in writing to a longer period within which the CEO must make the decision—within the longer period.
The CEO may decide to give the approval if the CEO is satisfied the applicant is—
appropriately qualified to carry out the scheme function for which the application is made; and
fit and proper to carry out the scheme function for which the application is made.

(sec.49J-ssec.1) The CEO must decide to give or refuse to give the approval— within 3 months after the application is made; or if the CEO and applicant agree in writing to a longer period within which the CEO must make the decision—within the longer period.

- (a) within 3 months after the application is made; or
- (b) if the CEO and applicant agree in writing to a longer period within which the CEO must make the decision—within the longer period.
