### sec.43 Dealing with records and information about a person’s fitness for work
The site senior executive for a coal mine must ensure information and records about a person’s fitness for work obtained under sections 41 and 42 —
are used only for deciding the person’s fitness for work at the mine; and
are destroyed—
for an employee of a regular contractor—18 months after the employee ceases to work at the mine; or
for an employee of another contractor or coal mine operator—when the employee ceases to be employed by the other contractor or operator.
- (a) are used only for deciding the person’s fitness for work at the mine; and
- (b) are destroyed— (i) for an employee of a regular contractor—18 months after the employee ceases to work at the mine; or (ii) for an employee of another contractor or coal mine operator—when the employee ceases to be employed by the other contractor or operator.
- (i) for an employee of a regular contractor—18 months after the employee ceases to work at the mine; or
- (ii) for an employee of another contractor or coal mine operator—when the employee ceases to be employed by the other contractor or operator.
- (i) for an employee of a regular contractor—18 months after the employee ceases to work at the mine; or
- (ii) for an employee of another contractor or coal mine operator—when the employee ceases to be employed by the other contractor or operator.
