### sec.253 Withdrawal of persons in case of danger caused by failure or non-operation of gas monitoring system
For section 273 of the Act , a part of an underground mine is taken to be dangerous if—
the part is affected by the failure or non-operation of the gas monitoring system; and
the mine does not have—
a standard operating procedure for using portable gas detectors; or
sufficient portable gas detectors to continually monitor the part to the extent necessary to achieve an acceptable level of risk.
- (a) the part is affected by the failure or non-operation of the gas monitoring system; and
- (b) the mine does not have— (i) a standard operating procedure for using portable gas detectors; or (ii) sufficient portable gas detectors to continually monitor the part to the extent necessary to achieve an acceptable level of risk.

- (ii) sufficient portable gas detectors to continually monitor the part to the extent necessary to achieve an acceptable level of risk.
