### sec.95 Person must be qualified to act as site safety and health representative
A person must not act as a site safety and health representative unless the person holds the competencies mentioned in section 93 (4) .
Maximum penalty—40 penalty units.
Subsection (1) does not apply to a person elected under section 94 (1) .
A site safety and health representative must perform the functions and exercise the powers of a site safety and health representative under this Act for safety and health purposes and for no other purpose.
Maximum penalty for subsection (3) —40 penalty units.
