### sec.195 Obtaining board qualifications by fraud
A person must not become, or attempt to become, the holder of a board qualification by giving false information to the board of examiners.
Maximum penalty—400 penalty units.
The board of examiners may cancel a board qualification by notice to the holder if the board is satisfied the holder obtained the qualification by giving false information to the board.
If the board of examiners decides to cancel a board qualification, the board must give notice of the decision to the following persons, to the extent the persons are known to the board—
for a decision relating to a certificate of competency—the site senior executive for each coal mine at which the holder works;
for a decision relating to a site senior executive notice—the coal mine operator for each coal mine at which the holder works;
for a decision relating to a practising certificate held by a site senior executive—the coal mine operator for each coal mine at which the holder works;
for a decision relating to a practising certificate held by a person other than a site senior executive—the site senior executive for each coal mine at which the holder works.
