### sec.72 Damages for personal injury
This section applies if loss of life or personal injury is suffered by a person on board a ship because of the fault of the ship and 1 or more other ships.
The liability of the owners of the ships is joint and several.
Nothing in this section—
deprives a person of any right of defence that the person has apart from this section; or
affects a person’s right to limit the person’s liability; or
affects the operation of the Law Reform Act 1995 , section 10 .
For circumstances within the scope of the Navigation Act 2012 (Cwlth) , see section 176 (3) (a) of that Act.
The Law Reform Act 1995 , section 10 deals with the apportionment of liability if there was contributory negligence by the injured or deceased person.
