### sec.52 Exemplary, punitive or aggravated damages can not be awarded              
A court can not award exemplary, punitive or aggravated damages in relation to a claim for personal injury damages.
Subsection (1) does not apply to a claim for personal injury damages if the act that caused the personal injury was—
an unlawful intentional act done with intent to cause personal injury; or
an unlawful sexual assault or other unlawful sexual misconduct.
(sec.52-ssec.1) A court can not award exemplary, punitive or aggravated damages in relation to a claim for personal injury damages.
(sec.52-ssec.2) Subsection (1) does not apply to a claim for personal injury damages if the act that caused the personal injury was— an unlawful intentional act done with intent to cause personal injury; or an unlawful sexual assault or other unlawful sexual misconduct.
- (a) an unlawful intentional act done with intent to cause personal injury; or
- (b) an unlawful sexual assault or other unlawful sexual misconduct.
