### sec.42 Order for suspension
On the application of a reportable offender mentioned in section 41 (2) , the Supreme Court may make an order suspending the offender’s reporting obligations.
The court must not make the order unless it is satisfied that the offender does not pose a risk to the safety of children.
When deciding whether to make the order, the court must take into account—
the seriousness of the offender’s reportable offences and corresponding reportable offences; and
the period of time since the offences were committed; and
the age of the offender, the age of the victims of the offences, and the difference in age between the offender and the victims, when the offences were committed; and
the offender’s present age; and
the offender’s criminal record; and
any other matter that the court considers appropriate.
(sec.42-ssec.1) On the application of a reportable offender mentioned in section 41 (2) , the Supreme Court may make an order suspending the offender’s reporting obligations.
(sec.42-ssec.2) The court must not make the order unless it is satisfied that the offender does not pose a risk to the safety of children.

- (a) the seriousness of the offender’s reportable offences and corresponding reportable offences; and
- (b) the period of time since the offences were committed; and
- (c) the age of the offender, the age of the victims of the offences, and the difference in age between the offender and the victims, when the offences were committed; and
- (d) the offender’s present age; and
- (e) the offender’s criminal record; and
- (f) any other matter that the court considers appropriate.
