### sec.40A Allowing DNA sample to be taken
A reportable offender must comply with a written notice given to the offender by the police commissioner requiring the offender to—
attend at a stated time and place; and
allow a DNA sampler to take a DNA sample from the offender for DNA analysis.
For the offence for failing to comply with a notice, see section 50 .
However, a reportable offender need not comply with subsection (1) if either of the following is currently kept under the Police Powers and Responsibilities Act 2000 —
a DNA sample taken from the reportable offender;
the results of a DNA analysis of the DNA sample.
The Police Powers and Responsibilities Act 2000 , chapter 17 , part 5 applies in relation to a DNA sample taken under this section.
