47 Certifier may request engineer’s certificate
(1) The owner of a parcel of land where building work is being, or has
been, carried out must, if required by the certifier, give the certifier a
certificate by an engineer about either of the following:
(a) the structural sufficiency, soundness and stability of the building
as erected or altered for the purposes for which the building is
to be occupied or used;
(b) matters relating to the health, safety and amenity of the building
that may affect whether the building, as erected or altered for the
purposes for which the building is to be occupied or used, is fit
for occupation or use.
(2) For subsection (1), the engineer must be—
(a) an engineer in the field for which the engineer is giving the
certificate; and
(b) if the engineer is required to be registered as a professional
engineer under the Professional Engineers Act 2023—
a professional engineer.
Examples—par (a)
1 An engineer giving a certificate about a matter mentioned in s 47 (1) (a) must
be a structural engineer.
2 An engineer giving a certificate about a matter mentioned in s 47 (1) (b) that
relates to fire protection and safety must be a fire engineer.
(3) The certifier may request a certificate only if satisfied on reasonable
grounds that it is desirable to do so in the interests of people who
occupy or use, or are likely to occupy or use, the building or part of
the building that is being, or has been, erected or altered.
(4) The certifier may request a certificate at any time before or after the
completion of building work.
