### sec.63A Restriction on granting building development approval for residential care building
This section applies to a building development application for building work that includes an alteration to a residential care building to which chapter 7A applies.
The assessment manager must not approve the application unless—
the application also relates to building work (if any) to be carried out to the rest of the residential care building; and
the assessment manager is satisfied that, after the building work is completed, the whole of the residential care building will comply with the fire safety standard (RCB).
In this section—
alteration , to a residential care building, means—
an alteration affecting more than 20% of the floor area of the building; or
an addition of more than 20% to the floor area of the building.

(sec.63A-ssec.1) This section applies to a building development application for building work that includes an alteration to a residential care building to which chapter 7A applies.
(sec.63A-ssec.2) The assessment manager must not approve the application unless— the application also relates to building work (if any) to be carried out to the rest of the residential care building; and the assessment manager is satisfied that, after the building work is completed, the whole of the residential care building will comply with the fire safety standard (RCB).
(sec.63A-ssec.3) In this section— alteration , to a residential care building, means— an alteration affecting more than 20% of the floor area of the building; or an addition of more than 20% to the floor area of the building.
- (a) the application also relates to building work (if any) to be carried out to the rest of the residential care building; and
- (b) the assessment manager is satisfied that, after the building work is completed, the whole of the residential care building will comply with the fire safety standard (RCB).
- (a) an alteration affecting more than 20% of the floor area of the building; or
- (b) an addition of more than 20% to the floor area of the building.
