### sec.55 Power to decide what stage of development assessment process under Planning Act application process may resume or start This section applies if— a private certifier (class A) is engaged to assess or decide a building development application; and the engagement is discontinued; and the application has not been decided; and a new private certifier (class A) is engaged for the application. This section also applies if— a building development approval lapses under part 7 ; and the owner of the land to which the approval attached immediately before it lapsed makes a new building development application for all or part of the building work under the lapsed approval. The assessment manager for the application or new application may resume or start the application process at any stage of the development assessment process under the Planning Act the assessment manager considers appropriate. s 55 ins 2006 No. 36 s 5 amd 2016 No. 27 s 68 (sec.55-ssec.1) This section applies if— a private certifier (class A) is engaged to assess or decide a building development application; and the engagement is discontinued; and the application has not been decided; and a new private certifier (class A) is engaged for the application.
