### sec.246AA Obligation to give pool safety certificate on inspection in particular circumstances
This section applies if a pool safety inspector inspects a regulated pool and the inspector is reasonably satisfied the pool is a complying pool.
The pool safety inspector must, within 2 business days after the inspection, give the owner of the pool a pool safety certificate for the pool.
The pool safety inspector must not refuse to give a pool safety certificate for the pool only on the ground that—
there is no development approval to carry out building work that is the construction of, or alteration to, the pool (the pool work ); or
the pool work does not comply with the development approval for the pool work.

(sec.246AA-ssec.1) This section applies if a pool safety inspector inspects a regulated pool and the inspector is reasonably satisfied the pool is a complying pool.
(sec.246AA-ssec.2) The pool safety inspector must, within 2 business days after the inspection, give the owner of the pool a pool safety certificate for the pool.
(sec.246AA-ssec.3) The pool safety inspector must not refuse to give a pool safety certificate for the pool only on the ground that— there is no development approval to carry out building work that is the construction of, or alteration to, the pool (the pool work ); or the pool work does not comply with the development approval for the pool work.

- (b) the pool work does not comply with the development approval for the pool work.
