### sec.234 Constructing regulated pool—requirement for compliance with pool safety standard This section applies to a person if— a regulated pool has been constructed or is being constructed; and the pool has not been filled with water to a depth of 300mm or more; and the person— is, or is to become, the owner of the pool; or has contracted with the owner to carry out the construction of the pool. The person must, unless the person has a reasonable excuse, ensure that, before the pool is filled with water to a depth of 300mm or more, a building certifier has provided a certificate in the approved form stating the pool is a complying pool.
