### sec.27 Aggravated offences—significant damage to health and safety of people or to the economy or environment
An offence is an aggravated offence if the commission of the offence causes significant damage, or is likely to cause significant damage, to the health and safety of people or to the economy or the environment.
To prove an aggravated offence, the prosecution must prove that the person who committed the offence—
intended the person’s conduct to cause significant damage to the health and safety of people or to the economy or the environment; or
was reckless as to whether the conduct would cause significant damage to the health and safety of people or to the economy or the environment.
(sec.27-ssec.1) An offence is an aggravated offence if the commission of the offence causes significant damage, or is likely to cause significant damage, to the health and safety of people or to the economy or the environment.
(sec.27-ssec.2) To prove an aggravated offence, the prosecution must prove that the person who committed the offence— intended the person’s conduct to cause significant damage to the health and safety of people or to the economy or the environment; or was reckless as to whether the conduct would cause significant damage to the health and safety of people or to the economy or the environment.
- (a) intended the person’s conduct to cause significant damage to the health and safety of people or to the economy or the environment; or
- (b) was reckless as to whether the conduct would cause significant damage to the health and safety of people or to the economy or the environment.
