### sch.3-sec.126 Existing pest management plans and draft plans
The pest management plan of a local government adopted under the amended Act, section 30 and in force immediately before the commencement is, from the commencement, taken to be the local government’s biosecurity plan for invasive biosecurity matter for its area for the period stated in the plan.
If, before the commencement, a local government was preparing its draft pest management plan under the amended Act, section 27 but, immediately before the commencement, had not adopted the plan, the local government may either—
complete the preparation and adoption of the plan in the way required under the amended Act, chapter 2, part 4; or
end the preparation of the plan under the amended Act and make a biosecurity plan for invasive biosecurity matter for its area under section 53 of the Act .
A pest management plan adopted by a local government in the way mentioned in subsection (2)(a) is taken to be the local government’s biosecurity plan for invasive biosecurity matter for its area for the period stated in the plan.
(sch.3-sec.126-ssec.1) The pest management plan of a local government adopted under the amended Act, section 30 and in force immediately before the commencement is, from the commencement, taken to be the local government’s biosecurity plan for invasive biosecurity matter for its area for the period stated in the plan.
(sch.3-sec.126-ssec.2) If, before the commencement, a local government was preparing its draft pest management plan under the amended Act, section 27 but, immediately before the commencement, had not adopted the plan, the local government may either— complete the preparation and adoption of the plan in the way required under the amended Act, chapter 2, part 4; or end the preparation of the plan under the amended Act and make a biosecurity plan for invasive biosecurity matter for its area under section 53 of the Act .
(sch.3-sec.126-ssec.3) A pest management plan adopted by a local government in the way mentioned in subsection (2)(a) is taken to be the local government’s biosecurity plan for invasive biosecurity matter for its area for the period stated in the plan.
- (a) complete the preparation and adoption of the plan in the way required under the amended Act, chapter 2, part 4; or
- (b) end the preparation of the plan under the amended Act and make a biosecurity plan for invasive biosecurity matter for its area under section 53 of the Act .
