### sec.40 Provisions concerning bail decisions under s 7 It is declared that a bail decision made under section 7 during the relevant period is not invalid only because the police officer making the decision lacked the capacity to make it. In this section— bail decision means a decision to grant, or refuse to grant, bail. relevant period means the period starting on 1 July 2000 and ending immediately before the commencement of this section. s 40 ins 2003 No. 92 s 18 (sec.40-ssec.1) It is declared that a bail decision made under section 7 during the relevant period is not invalid only because the police officer making the decision lacked the capacity to make it.
