### sec.35 Proceedings for offences
A prosecution for an offence against this Act shall be taken by way of summary proceedings in accordance with the provisions of the Justices Act 1886 (subject to such modifications to those provisions as are made by sections 33 and 33A ), and may be taken notwithstanding that more than 1 year has elapsed since the commission of the offence.
A person who commits an offence against this Act shall be liable to a penalty of 40 penalty units or to imprisonment for 2 years.
