### sec.33B Committal or remand of certain defendants
Where a defendant appears before a Magistrates Court or, as the case may be, Childrens Court (the first mentioned court ) charged with an offence against section 33 , the first mentioned court, whether or not it convicts the defendant of that offence, without further inquiry or examination, shall commit the defendant to be dealt with according to law by the court that issued the warrant referred to in section 33 (1) (b) for the offence in respect of which the defendant failed to surrender into custody unless the first mentioned court deals with the defendant under section 33A for the offence.
A court in exercising the jurisdiction conferred by subsection (1) may grant bail to the defendant or by its warrant commit the defendant to prison with a direction to the chief executive (corrective services) to cause the defendant to surrender into the custody of the court that issued the warrant referred to in section 33 (1) (b) in accordance with the defendant’s undertaking at the time and place for the time being appointed for the defendant to do so.
