9 Substitution of references to the Attorney-General8
Unless the Prime Minister is satisfied that exceptional9
circumstances exist, the Governor-General must not make a10
substituted reference order under subsection 19B(2) of the Acts11
Interpretation Act 1901 that relates to a provision of this Act that12
refers to the Attorney-General.13

10 Meaning of serious and organised crime2
(1) For the purposes of this Act, serious and organised crime means a3
federal offence that may have been committed, may presently be4
being committed, or may in future be committed, in circumstances5
involving:6
(a) 2 or more offenders; and7
(b) substantial planning or organisation; and8
(c) the use of sophisticated methods and techniques.9
(2) A federal offence is an offence:10
(a) against a law of the Commonwealth; or11
(b) against a law of a State that has a federal aspect;12
that is:13
(c) punishable by imprisonment for a period of 2 years or more;14
or15
(d) prescribed by the rules.16
Note: See section 11 for when a State offence has a federal aspect.17
Interpretation18
(3) For the purposes of this section, State includes the Australian19
Capital Territory and the Northern Territory.20
