75 Offence—failure to attend examination7
(1) A person commits an offence if:8
(a) the person is served with a summons to attend an9
examination; and10
(b) the person:11
(i) fails to attend and appear as required by the summons;12
or13
(ii) fails to attend and appear from day to day as required by14
the summons; or15
(iii) fails to appear by way of video link, audio link or other16
means if so directed by the examiner conducting the17
examination under subsection 61(1) or 64(1); and18
(c) the person has not been excused or released from further19
attendance by an examiner.20
Penalty: Imprisonment for 5 years or 300 penalty units, or both.21
No continuing offence or contraventions22
(2) Section 4K (continuing offences) of the Crimes Act 1914 does not23
apply in relation to an offence against subsection (1).24
76 Offence—failure to give information, or produce documents or25
things26
A person commits an offence if:27
(a) the person is required, under subsection 59(4) or 65(1), to28
give information, or produce a document or thing, during an29
examination; and30

(b) the person fails to give the information, or produce the1
document or thing, in accordance with that requirement.2
Penalty: Imprisonment for 5 years or 300 penalty units, or both.3
