266 Directions by the Director-General—administration and control7
of the ACIC8
(1) The Director-General may, by writing, give directions to ACIC9
employees in connection with the administration and control of the10
ACIC.11
Essential qualifications12
(2) Without limiting subsection (1), directions under that subsection13
may relate to the essential qualifications for ACIC employees for14
performing their duties.15
Note 1: See section 23 of the Public Service Act 1999 for the reduction in the16
classification of an ACIC employee in the ACIC if the employee17
lacks, or has lost, an essential qualification for performing the18
employee’s duties.19
Note 2: See section 29 of the Public Service Act 1999 for the termination of20
the employment of an ACIC employee in the ACIC if the employee21
lacks, or has lost, an essential qualification for performing the22
employee’s duties.23
(3) Without limiting subsection (2), essential qualifications may have24
one or more of the following components:25
(a) physical or psychological health or fitness;26
(b) professional or technical qualifications;27
(c) learning and development requirements;28
(d) security clearances;29
(e) organisational suitability assessments.30

Reporting of serious misconduct or criminal activity1
(4) Without limiting subsection (1), directions under that subsection2
may relate to the reporting by ACIC employees of the following:3
(a) serious misconduct by an ACIC employee;4
(b) criminal activity involving an ACIC employee;5
where the serious misconduct or criminal activity affects, or is6
likely to affect, the operations, responsibilities or reputation of the7
ACIC.8
Compliance with directions9
(5) An ACIC employee must comply with a direction under this10
section.11
Note: See subsection 13(4) and sections 15, 28 and 29 of the Public Service12
Act 1999 for the consequences of an ACIC employee not complying13
with this subsection.14
Directions not legislative instruments15
(6) A direction under this section is not a legislative instrument.16
No limit on other powers to give directions17
(7) This section does not limit any other power of the Director-General18
to give directions to any person.19
Ministerial directions and guidelines prevail20
(8) Directions given by the Minister under subsection 37(1), and21
guidelines made by the Minister under section 39, prevail over any22
directions given by the Director-General under this section to the23
extent of any inconsistency.24
