### sec.88 Amalgamation does not affect certain rights and obligations
The amalgamation of old associations into a new association does not—
affect a right or obligation of the old associations or anyone else; or
make legal proceedings by or against an old association defective.
Without limiting subsection (1) , the amalgamation of the old associations into a new association does not affect a right, obligation or benefit the new association would have had or enjoyed apart from the amalgamation of the old associations.
Also, but without limiting subsection (1) , if a legal proceeding might have been continued or started by or against an old association, it may be continued or started by or against the new association.

(sec.88-ssec.1) The amalgamation of old associations into a new association does not— affect a right or obligation of the old associations or anyone else; or make legal proceedings by or against an old association defective.
(sec.88-ssec.2) Without limiting subsection (1) , the amalgamation of the old associations into a new association does not affect a right, obligation or benefit the new association would have had or enjoyed apart from the amalgamation of the old associations.
(sec.88-ssec.3) Also, but without limiting subsection (1) , if a legal proceeding might have been continued or started by or against an old association, it may be continued or started by or against the new association.
- (a) affect a right or obligation of the old associations or anyone else; or
- (b) make legal proceedings by or against an old association defective.
