### sec.33 Incorporated association may be exempted from using word ‘incorporated’
An association may, by resolution of its members, decide to apply to the chief executive for exemption from section 29 —
at the time of incorporation of the association; or
if it is an incorporated association—at another time.
The application must be in the approved form and be accompanied by the information, documents and fees required under the regulations.
After considering the application, the chief executive may grant or refuse it.
Within 14 days after granting or refusing the association’s application, the chief executive must give written notice of the decision to the association.
If the application is granted, the chief executive must require the association to notify members of the public of the grant within 30 days after being informed by the chief executive of the grant.
The chief executive may require the association to give the notice by public advertisement and other ways the chief executive considers appropriate.
If the application is refused, the notice to the association must include the chief executive’s reasons for the decision.
