### sec.50F Disclosure to, or with consent of, person to whom confidential information relates
A designated officer may disclose confidential information if—
for confidential information relating to an adult—
the disclosure is to the adult; or
the adult consents to the disclosure; or
for confidential information relating to a child—
the disclosure is to the child or an authorised person for the child; or
the officer is a health professional who reasonably believes the child has capacity to consent and the child consents to the disclosure; or
the officer is a health professional who reasonably believes the disclosure is in the child’s best interests; or
an authorised person for the child consents to the disclosure.
In this section—
authorised person , for a child, means a person who is authorised to consent on the child’s behalf to the disclosure of confidential information relating to the child.
a parent or guardian of the child
capacity to consent , in relation to a child, means the child is of sufficient age, and mental and emotional maturity, to understand the nature of consenting to the disclosure of confidential information.

(sec.50F-ssec.1) A designated officer may disclose confidential information if— for confidential information relating to an adult— the disclosure is to the adult; or the adult consents to the disclosure; or for confidential information relating to a child— the disclosure is to the child or an authorised person for the child; or the officer is a health professional who reasonably believes the child has capacity to consent and the child consents to the disclosure; or the officer is a health professional who reasonably believes the disclosure is in the child’s best interests; or an authorised person for the child consents to the disclosure.
(sec.50F-ssec.2) In this section— authorised person , for a child, means a person who is authorised to consent on the child’s behalf to the disclosure of confidential information relating to the child. a parent or guardian of the child capacity to consent , in relation to a child, means the child is of sufficient age, and mental and emotional maturity, to understand the nature of consenting to the disclosure of confidential information.
- (a) for confidential information relating to an adult— (i) the disclosure is to the adult; or (ii) the adult consents to the disclosure; or
- (i) the disclosure is to the adult; or
- (ii) the adult consents to the disclosure; or
- (b) for confidential information relating to a child— (i) the disclosure is to the child or an authorised person for the child; or (ii) the officer is a health professional who reasonably believes the child has capacity to consent and the child consents to the disclosure; or (iii) the officer is a health professional who reasonably believes the disclosure is in the child’s best interests; or (iv) an authorised person for the child consents to the disclosure.
- (i) the disclosure is to the child or an authorised person for the child; or
- (ii) the officer is a health professional who reasonably believes the child has capacity to consent and the child consents to the disclosure; or
- (iii) the officer is a health professional who reasonably believes the disclosure is in the child’s best interests; or
- (iv) an authorised person for the child consents to the disclosure.
- (i) the disclosure is to the adult; or
- (ii) the adult consents to the disclosure; or
- (i) the disclosure is to the child or an authorised person for the child; or
- (ii) the officer is a health professional who reasonably believes the child has capacity to consent and the child consents to the disclosure; or
- (iii) the officer is a health professional who reasonably believes the disclosure is in the child’s best interests; or
- (iv) an authorised person for the child consents to the disclosure.
