### sec.5 Disqualification from appointment
A person who—
is an undischarged bankrupt or takes advantage of the laws in force for the time being relating to bankruptcy; or
has been or is convicted in Queensland of an indictable offence or has been or is convicted elsewhere in respect of an act or omission that if done or made by that person in Queensland would have constituted an indictable offence;
is not capable of being or continuing to be the commissioner.
