### sec.33 Definitions for div 3
In this division—
agent includes a person who is an agent at the start of an audit period, even if the person stops being an agent before the end of the audit period.
audit month , for an agent, means—
if the agent is a licensee—
the eighth month after the month in which the licence was first issued to the licensee and the same month in each subsequent year; or
another month stated by the chief executive in a written notice given to the licensee; or
If a licensee’s licence was first issued to the licensee in January, the audit month for the licensee’s licence is September.
if the agent is a collection agent—the month of June.
audit period means—
the 12 month period in each year ending on the last day of the audit month; or
another period decided by the chief executive, either generally by gazette notice, or by written notice given to an agent.
audit report , for an agent, means a report from the agent’s auditor under section 40 .
trust account means a general trust account or a special trust account.
- (a) if the agent is a licensee— (i) the eighth month after the month in which the licence was first issued to the licensee and the same month in each subsequent year; or (ii) another month stated by the chief executive in a written notice given to the licensee; or Example of paragraph (a) (i) — If a licensee’s licence was first issued to the licensee in January, the audit month for the licensee’s licence is September.
- (i) the eighth month after the month in which the licence was first issued to the licensee and the same month in each subsequent year; or
- (ii) another month stated by the chief executive in a written notice given to the licensee; or Example of paragraph (a) (i) — If a licensee’s licence was first issued to the licensee in January, the audit month for the licensee’s licence is September.
- (b) if the agent is a collection agent—the month of June.
- (i) the eighth month after the month in which the licence was first issued to the licensee and the same month in each subsequent year; or
