139 When administrators may be appointed
(1) The commissioner for fair trading may appoint someone to administer
the business of a licensed agent or former licensed agent if any of the
following occurs:
(a) the agent’s licence is suspended or cancelled;
(b) the agent is disqualified from holding a licence;
(c) the agent’s licence has expired;
(d) the agent surrenders the licence under section 39;
(e) the agent is missing and cannot be located after making
reasonable enquiries;
(f) the agent dies.
Note 1 For the making of appointments (including acting appointments), see the
Legislation Act, pt 19.3.
Note 2 In particular, a person may be appointed for a particular provision of a
law (see Legislation Act, s 7 (3)) and an appointment may be made by
naming a person or nominating the occupant of a position (see Legislation
Act, s 207).
(2) The commissioner for fair trading may appoint someone to administer
the business of a person who is not a licensed agent if the person is—
(a) carrying on business as an agent; or
(b) pretending to be a licensed agent.
