### sec.46 Counselling for Aboriginal or Torres Strait Islander child
This section applies to the counselling under section 45 if the child is an Aboriginal person or Torres Strait Islander.
The counselling must be carried out in a way and at a place that is appropriate to Aboriginal tradition or Island custom.
A person who, as part of the counselling, explains the information under section 44 (3) , definition prescribed information , paragraph (i) —
need not be a counsellor under section 45 ; but
must be an appropriate Aboriginal or Torres Strait Islander person.
This section does not apply to the extent the child declines to receive counselling in a way, or by a person, required by this section.
(sec.46-ssec.1) This section applies to the counselling under section 45 if the child is an Aboriginal person or Torres Strait Islander.
