### sec.307 Fraud or undue influence
A person must not act fraudulently or use undue influence on another person to—
induce a parent of a child to—
offer or refrain from offering the child for adoption; or
give or revoke the parent’s consent to the adoption of the child; or
transfer a child’s care or custody with a view to the child’s adoption; or
influence the preferences expressed by a parent of a child relating to the adoptive placement of the child.
Maximum penalty—150 penalty units or 18 months imprisonment.
For this section, a person uses undue influence on another person if the first person—
uses or threatens to use force or restraint against the other person; or
causes or threatens to cause injury or another detriment to the other person.
It is immaterial whether the adoption happens or may lawfully happen.

(sec.307-ssec.2) For this section, a person uses undue influence on another person if the first person— uses or threatens to use force or restraint against the other person; or causes or threatens to cause injury or another detriment to the other person.
(sec.307-ssec.3) It is immaterial whether the adoption happens or may lawfully happen.
- (a) induce a parent of a child to— (i) offer or refrain from offering the child for adoption; or (ii) give or revoke the parent’s consent to the adoption of the child; or (iii) transfer a child’s care or custody with a view to the child’s adoption; or
- (i) offer or refrain from offering the child for adoption; or
- (ii) give or revoke the parent’s consent to the adoption of the child; or
- (iii) transfer a child’s care or custody with a view to the child’s adoption; or
- (b) influence the preferences expressed by a parent of a child relating to the adoptive placement of the child.
- (i) offer or refrain from offering the child for adoption; or
- (ii) give or revoke the parent’s consent to the adoption of the child; or
- (iii) transfer a child’s care or custody with a view to the child’s adoption; or
- (a) uses or threatens to use force or restraint against the other person; or
- (b) causes or threatens to cause injury or another detriment to the other person.
