### sec.198 Chief executive to supervise child’s wellbeing and interests
This section applies while the child is in the custody of the prospective adoptive parents—
under section 192 ; or
because an interim order in favour of the prospective adoptive parents is in force under this division; or
because the chief executive, whether as the child’s guardian or otherwise, placed the child in their custody under a delegation from the Commonwealth Minister; or
because the Commonwealth Minister, as the child’s guardian under the Commonwealth Act, placed the child in their custody.
The chief executive must supervise the child’s wellbeing and interests.
The chief executive may, by written notice, require the prospective adoptive parents to pay the fee prescribed under a regulation for the supervision.
The notice must state the time, not less than 30 days after the notice is given, by which the fee must be paid.
In this section—
Commonwealth Act means the Immigration (Guardianship of Children) Act 1946 (Cwlth) .
Commonwealth Minister means the Minister responsible for administering the Commonwealth Act.
