### sec.159 Eligibility
The chief executive must be satisfied a person to be selected as a prospective adoptive parent is still eligible.
For subsection (1) , a person selected for assessment under section 88 from the expression of interest register is still eligible if the person is eligible to have the person’s name remain in the expression of interest register under section 76 .
Also, for subsection (1) , a person selected for assessment under section 89 is still eligible if—
the person is still a person mentioned in section 89 (8) (b) (ii) to (v) ; and
for a person selected for assessment jointly with the person’s spouse—the spouse is still the person’s spouse; and
for a person who did not have a spouse when the person was selected for assessment—the person does not have a spouse.
For subsection (2) , a person does not become ineligible to have the person’s name remain in the expression of interest register under section 76 on the ground of being pregnant unless the person is at least 14 weeks pregnant.

(sec.159-ssec.3) Also, for subsection (1) , a person selected for assessment under section 89 is still eligible if— the person is still a person mentioned in section 89 (8) (b) (ii) to (v) ; and for a person selected for assessment jointly with the person’s spouse—the spouse is still the person’s spouse; and for a person who did not have a spouse when the person was selected for assessment—the person does not have a spouse.
(sec.159-ssec.4) For subsection (2) , a person does not become ineligible to have the person’s name remain in the expression of interest register under section 76 on the ground of being pregnant unless the person is at least 14 weeks pregnant.
- (a) the person is still a person mentioned in section 89 (8) (b) (ii) to (v) ; and
- (b) for a person selected for assessment jointly with the person’s spouse—the spouse is still the person’s spouse; and
- (c) for a person who did not have a spouse when the person was selected for assessment—the person does not have a spouse.
