### sec.35C Headings part of provision etc.
The heading to a chapter, part, division, subdivision, section, subsection, schedule or another provision of an Act forms part of the provision to which it is a heading.
An example of the operation of a provision of an Act at the end of the provision is part of the provision unless the example relates to a different provision.
This example forms part of subsection (2) and an amendment omitting subsection (2) would omit this example.
A note to a provision of an Act at the end of the provision is part of the provision unless the note relates to a different provision.
A penalty at the end of a subsection of an Act—
is part of the subsection unless the penalty relates to other subsections of the section; or
in any other case—is part of the section.
A penalty at the end of a section of an Act that is not divided into subsections is part of the section.
The word ‘and’, ‘or’ or ‘but’, or a similar word, at the end of a paragraph, subparagraph, sub-subparagraph or another provision of an Act forms part of the provision concerned.
The word ‘and’, ‘or’ or ‘but’, or a similar word, between paragraphs, subparagraphs, sub-subparagraphs or other provisions of an Act forms part of the first of the provisions.
A provision reference associated with a heading to a schedule is part of the heading.
The provision referred to is the authorising provision or another provision relevant to the schedule.

- (a) is part of the subsection unless the penalty relates to other subsections of the section; or
- (b) in any other case—is part of the section.
