Background to the substantive matter
- The Applicant, Steven Vitale was issued with a category AB firearms licence on 28 August 2016 for the genuine reason of recreational hunting/vermin control. On 28 December 2018 a category H licence was added. All were to expire on 13 October 2021. On 4 November 2020 his firearms licence was revoked pursuant to s 24(2)(d) of the Firearms Act 1996 (FA Act) and cl 20 of the Firearms Regulation 2017, that is, on public interest grounds. That decision was affirmed on internal review. On 10 March 2021 the Applicant sought review of the decision (the substantive matter).
- The Statement of Reasons prepared following the internal review recorded that the Applicant was known to associate with persons who have extensive criminal histories and that this was of particular concern regarding his suitability to maintain a firearms licence.
