- The applicant (the VLSC)[1] has brought two charges of unsatisfactory professional conduct against Mr McDonald, a solicitor, under the Legal Profession Act 2004 (the Act). The applicant alleged that in two letters, written on 30 August 2011 and 2 September 2011, in making certain allegations against an opposing solicitor, Mr McDonald had breached Rule 21 of the Professional Conduct and Practice Rules 2005 (Rules), namely:
A practitioner, in all the practitioner's dealings with other practitioners, must take all reasonable care to maintain the integrity and reputation of the legal profession by ensuring that the practitioner's communications are courteous and that the practitioner avoids offensive or provocative language or conduct.
